DHS to begin accepting applications for deferred action August 15, 2012.

The Department of Homeland Security will begin accepting applications for deferred action filed by foreign nationals who came to the United States as youth, and meet certain other criteria. The DHS will publish the form and filing instructions on August 15, 2012. Binsfeld & Engebretson recommends that anyone who believes they may be eligible for this new process obtain a professional evaluation by an attorney before submitting an application to DHS.

The U.S. Department of Homeland Security announced a deferred action process for young people who entered the United States under age 16 and are low enforcement priorities. Please contact our office if you feel you might qualify for this benefit.

US CIS Intends to Change Waiver Application Process

On January 9, 2012 the US CIS posted a notice in the Federal Register expressing its intent to change the way US CIS processes applications for waivers of inadmissibility. Specifically, the US CIS is seeking to change the current process so that a foreign national who requires an application to waive inadmissibility for unauthorized presence in the United States may file that waiver application before departing the United States to apply for an immigrant visa.

Professional employees from China and India see progress in visa availability

The Department of State recently issued the visa bulletin for February 2012. The visa bulletin provides information about when certain foreign nationals will be eligible to receive immigrant visas.

Immigrant visas will be available to Chinese and Indian nationals in the employment-based second preference category whose priority dates are January 1, 2010 or sooner. This is significant progress, as the visa numbers progressed one year in only one month.
